Terms of Service
The AmpliHit Terms of Service is the legal agreement governing your use of AmpliHit’s music discovery, smart link, release management, and promotion tools. By creating an account or using the service, you agree to these terms, subject to any consent requirements and non-waivable rights under applicable law.
1. Music rights, content ownership and copyright complaints
Ownership. You retain ownership of your submitted recordings, compositions, lyrics, artwork, videos, metadata, descriptions, artist names, logos, trademarks and links (your “Content”). AmpliHit does not acquire ownership of your music or act as your record label, publisher or performing-rights organization.
Your warranty of rights. Each time you submit Content, you represent and warrant that you own or hold all licenses, permissions and rights necessary for its submission and every use you authorize on AmpliHit. This includes applicable master-recording, composition, synchronization, mechanical, public-performance, artwork, lyrics, sample, collaborator, likeness and trademark permissions. A public link, paid streaming subscription or permission to listen is not a license to rebroadcast, reproduce or promote a recording. You must resolve ownership disputes and pay amounts owed to contributors and rights holders. You must provide reasonable evidence of authorization when requested and promptly remove Content whose authorization has expired or been withdrawn.
Limited platform license. You grant AmpliHit a worldwide, royalty-free, non-exclusive license to host, store, reproduce, display, technically format and transmit your Content solely to operate the service and promote your submitted releases through the features you authorize. Streaming through third-party embeds remains subject to that provider’s permissions and terms. Direct audio playback, excerpts or promotional use require the necessary rights and any feature-specific consent. We may permit hosting and processing providers to exercise this license only as necessary to deliver these services. This license does not authorize unrelated resale, ownership transfer or uses outside these purposes.
The license lasts while your Content is available through the service. After removal or account closure, we cease new promotional use and remove hosted public copies within a reasonable technical period, except legally required records, limited backups and material already lawfully shared with others. External posts, third-party caches and recipients’ copies may remain outside our control. Separate promotion permissions are described below.
Copyright agent status. AmpliHit has not yet appointed or registered a DMCA designated agent. The reporting procedure below is an interim copyright-complaint channel, not a statement that AmpliHit qualifies for DMCA safe-harbor protection. Agent contact details will be published when an agent is appointed. Statutory protection depends on satisfying applicable legal requirements, not merely publishing these terms.
Report infringement. Use our public Contact page with the heading “Copyright complaint” and the exact AmpliHit URL at issue. If the form cannot accommodate your full notice, send an initial summary and request instructions for supplying the complete notice and evidence. Do not send confidential documents or sensitive information unnecessary to the complaint.
A complete notice should include: (a) your physical or electronic signature; (b) identification of the copyrighted work, or a representative list of works; (c) identification of the allegedly infringing material or link and information sufficient to locate it, including exact URLs; (d) your name, mailing address, telephone number and email; (e) a statement of good-faith belief that the disputed use is not authorized by the rights holder, its agent or law; and (f) a statement that the information is accurate and, under penalty of perjury, you are the owner or authorized to act for the owner. Consider lawful uses, including applicable exceptions, before submitting a complaint.
Response and repeat infringers. We review sufficiently detailed reports, act expeditiously to remove or disable access where appropriate and notify the submitting user when practicable. We may request clarification and disclose relevant complaint information to the affected user. Our policy is to terminate, in appropriate circumstances, accounts of repeat infringers; a serious single infringement may also justify suspension or termination. Users may not evade restrictions by opening new accounts.
Disputing a removal. If you believe removal resulted from mistake or misidentification, contact us with “Copyright counter-notice.” A statutory counter-notice, where applicable, requires your signature; identification of the removed material and its former location; a statement under penalty of perjury of your good-faith belief that removal was mistaken; your name, address and telephone; consent to the jurisdiction of the federal district court for your address, or, if outside the United States, a district where the service provider may be found; and agreement to accept service from the original complainant or its agent. We may forward it to the complainant. Where the DMCA procedure applies, restoration follows its 10–14-business-day timetable unless we receive notice of a court action seeking to restrain the disputed activity. Independently unlawful or otherwise prohibited material may remain restricted.
Knowingly making material misrepresentations in a notice or counter-notice can result in legal liability. This policy does not replace legal advice or notices required by other applicable laws.
2. Streaming embeds and third-party services
AmpliHit is an independent music discovery, link-routing and promotion service. It is not affiliated with, endorsed by or sponsored by Spotify, Apple Music, YouTube, Tidal or Deezer. Their names, logos and trademarks belong to their respective owners. Connections to other services do not imply endorsement or partnership.
Third-party players, links, APIs and account connections are controlled by their providers. Availability may depend on your territory, subscription, device, login, age, privacy choices and the provider’s policies. Providers may change interfaces, impose limits, disable embeds, remove recordings or revoke access without our control. A link that worked previously may stop working.
You must comply with each provider’s applicable terms, developer/API rules and content restrictions when submitting links or authorizing integrations. Do not bypass access controls, download or rebroadcast protected audio without permission, manipulate listening activity or use unauthorized automation. Playback must remain within the rights and functionality allowed by the source provider; inclusion on AmpliHit does not expand those rights.
AmpliHit does not calculate, collect or pay third-party streaming, mechanical or performance royalties. Reporting and payments are handled by your distributor, label, publisher, collecting society or the streaming provider under their agreements. We do not guarantee per-stream payouts, monetization eligibility, royalty accounting or that a visit, embed interaction or preview counts as a monetized stream.
AmpliHit activity statistics measure activity observed by our service, not certified third-party stream counts or royalty statements. Attribution, unique-listener estimates and geographic information may be incomplete or inaccurate. You remain responsible for verifying external reporting and maintaining your third-party accounts.
3. Pitching, boosts and Global Radio: no guaranteed placement
AmpliHit’s curator-pitching features are organizational CRM and direct-outreach utilities. Recommendations, directories and draft pitches are tools for your own evaluation, not promises that a contact is interested, reachable or accepting submissions. Curators independently decide whether to respond, review, feature or reject your music.
Buying a subscription, boost, outreach service or other paid feature does not guarantee playlist placement, blog coverage, radio chart position, curator responses, listener growth, viral success, earnings or a particular number of plays. Fees purchase only the features or services expressly described at checkout. Non-selection or lack of response alone is not a service failure or a basis for a refund.
AmpliHit does not authorize payola, undisclosed paid editorial placement or buying artificial streams. You must not offer unlawful inducements, misrepresent paid exposure as independent editorial selection or imply a curator’s endorsement without permission. Disclose sponsorship and promotional relationships wherever law or platform policy requires.
Global Radio is an automated online discovery feed using eligible, available links, embeds or specifically authorized audio. It is not traditional terrestrial radio broadcasting. Inclusion, position, frequency and duration depend on eligibility, availability, rotation logic, licensing and moderation. We may modify rotations or remove unavailable or noncompliant entries. Inclusion does not guarantee continuous playback, a fixed audience, external chart recognition or any minimum listening time.
4. Billing, subscriptions, trials and automatic renewal
Recurring charges. Standard subscription options include monthly fees of $14.99, $29.99 or $49 and annual fees of $149 or $490, in US dollars. Availability, selected plan, billing interval, applicable taxes, discounts and any special offer are disclosed at checkout. The specific terms you accept at checkout determine your subscription; not every price is available for every plan.
Automatic renewal. By expressly accepting a recurring subscription at checkout, you authorize the payment provider to charge your selected payment method at the disclosed monthly or annual interval until you cancel. Renewal is for the same interval unless you agree to change it. A failed payment may result in retries as permitted by law and the provider’s terms, or restricted access. We provide legally required notices and obtain additional consent where required for price or renewal-term changes.
Promotional trials. Promotional trials (for example a partner, tester or campaign code) are governed by the terms disclosed when the trial is redeemed. Trials never require a payment card and never convert automatically to a paid subscription. When a trial ends, the account moves to the free Rehearsal tier automatically. A paid plan is only ever activated by a separate subscription checkout that you complete and expressly confirm.
Cancel before renewal. Sign in, open Profile, find “Manage subscriptions · cancel anytime,” choose “Cancel subscription” for the relevant plan, and complete the confirmation. Retain the cancellation confirmation. Cancel each separate subscription you want to stop. Deleting the app, closing a browser or stopping use does not cancel a subscription. If cancellation fails or your subscription is not displayed, contact us promptly through the Contact page before your trial or renewal deadline.
Cancellation stops future renewals; it does not reverse fees already incurred. Paid access generally continues through the current paid period unless the checkout terms, a required legal remedy or a termination for breach provides otherwise. Trial-access duration is governed by the trial disclosure. No future renewal is due after an effective cancellation.
Refund policy. Except as required by applicable law or expressly promised in a specific written offer, fees are non-refundable. We do not provide prorated refunds for partial billing cycles, unused months, unused features, voluntary cancellation or disappointing promotion results. This policy does not limit mandatory consumer withdrawal rights, remedies for defective or undelivered services, corrections of unauthorized or duplicate charges, or lawful payment disputes. Report billing errors promptly with enough information to identify the transaction; never send your full card number.
5. Fan email capture, privacy and anti-spam
When you use smart links to collect fan contact details, you are responsible for the lawful collection and marketing use of those contacts as the artist or label deciding those purposes. You must comply with applicable laws, including CAN-SPAM, GDPR and UK GDPR, CASL, and CCPA/CPRA where applicable. AmpliHit remains responsible for its own legal obligations; these terms do not transfer obligations that law assigns to us.
Provide a clear privacy notice identifying who collects the information, the purpose of collection, intended recipients, retention and how individuals exercise their rights. Obtain and retain evidence of any required informed, specific consent, including confirmation where applicable. A visit, music play or account registration alone is not consent to marketing. Honor purpose limitations, minimize collection, protect exported lists and comply with applicable international-transfer requirements. Arrange any legally required data-processing agreement before using the service for processing that requires it.
Marketing messages must identify the actual sender, use truthful headers and subject lines, provide a valid postal address where required and include a clear, functioning unsubscribe mechanism. Promptly honor opt-outs within the applicable legal deadline, maintain suppression records and respect requests for access, correction, deletion and other applicable rights. Do not re-add unsubscribed contacts without a new lawful basis and any required consent.
You may not use captured contacts for unsolicited bulk email, purchased-list campaigns without lawful authorization, scams, phishing, malicious code, deceptive marketing or unrelated undisclosed purposes. Do not sell or share fan data without any disclosures, permissions and opt-out mechanisms required by law. You are responsible for your campaigns, collaborators and connected email accounts. We may restrict abusive collection or messaging.
Our own handling of personal information is described in the Privacy Policy. Availability of a collection or email feature is not a certification that your campaign complies with every jurisdiction’s laws.
6. Acceptable use, account security and termination
You must be at least 16 years old and legally able to enter this agreement; where required, a parent or guardian must authorize your use. The minimum age is not waived by parental consent. Keep registration information accurate, protect account credentials and report suspected unauthorized access. You are responsible for activity you authorize through your account.
Registration requires confirmation that you are at least 16, acceptance of these Terms of Service, and acknowledgment of the Privacy Policy. Email signup checks your self-reported date of birth; Google signup requires an age check after sign-in, before access to account tools. This is not identity-document verification. Marketing, music licensing and connected-account publishing permissions remain separate.
Weekly challenge voting and listener feedback require sign-in. Voter identities are not displayed publicly, but account-linked records are retained for participation limits and moderation. Administrators may access identifying feedback information; participation is not fully anonymous internally.
Prohibited conduct includes bot traffic, fake clicks or artificial streams; manipulation of smart-link, radio, voting or engagement metrics; unauthorized scraping or bulk extraction of curator directories or user data; credential misuse; bypassing limits, security or access controls; and reverse-engineering or copying platform code except to the extent a non-waivable law permits it.
Do not distribute infringing content, unlawful explicit media, child sexual abuse material, malware or illegal material; incite hatred or violence; threaten, harass, impersonate or defame curators or other people; disclose private information without authority; send spam; submit fraudulent claims; or use the service in violation of law or another provider’s rules. Lawful criticism is not prohibited merely because it is unfavorable.
We may remove Content, restrict features or suspend or terminate an account immediately and without prior notice for violations, serious suspected abuse, infringement, security risks or legally required action, to the extent permitted by law. Termination for breach does not entitle you to a refund except where law requires one. We may notify you and consider an explanation where appropriate, but prior warning is not guaranteed.
You may not evade termination by creating replacement accounts. Upon termination, your right to use the service ends; eligible recurring subscriptions must not continue renewing solely because an account has been terminated. Content may be removed, subject to lawful retention requirements. Provisions intended to survive, including accrued payment obligations, ownership, liability and applicable dispute provisions, survive termination. Non-waivable legal remedies remain available.
7. Warranty disclaimers and limitation of liability
As is and as available. To the fullest extent permitted by applicable law, the service is provided “as is” and “as available,” without express or implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant uninterrupted uptime, error-free operation, permanent storage, accurate analytics, successful link redirects, third-party availability, security against every threat or particular promotional outcomes.
Outages, technical glitches, incorrect links, lost data, delayed delivery and provider restrictions may occur. Maintain your own backups, verify release details and URLs and independently check third-party accounts. AmpliHit is not responsible for lost streaming revenue attributable to interruptions to the extent such liability may lawfully be excluded.
Excluded damages. To the fullest extent permitted by law, AmpliHit and its operator are not liable for indirect, incidental, consequential, special, exemplary or punitive damages, or lost profits, royalties, opportunities, goodwill or data, arising from the service, even if advised of their possibility.
Liability cap. To the fullest extent permitted by law, the aggregate liability of AmpliHit and its operator for claims arising from or relating to the service or these terms is limited to the total amount you actually paid AmpliHit during the 12 months immediately preceding the event giving rise to the claim. This is a total cap, not a separate cap for each claim, regardless of the legal theory asserted.
These exclusions and limits do not exclude or limit liability that applicable law forbids excluding or limiting, including mandatory consumer protections and, where applicable, fraud, intentional misconduct, gross negligence or death or personal injury caused by negligence. Where a restriction is unenforceable, it applies only to the maximum lawful extent.
8. Disputes, applicable law and changes
AmpliHit is operated by an individual, not represented in these terms as an incorporated company. Contact the operator through the public Contact page with account, copyright or contractual questions.
If a dispute arises, you may contact us with a description of the issue and the remedy requested so we can try to resolve it informally. This does not prevent you from exercising statutory rights, seeking urgent relief or meeting a legal filing deadline.
These terms do not currently select a particular state or country’s governing law, an exclusive court venue or an arbitration administrator. Applicable law and competent jurisdiction are determined by the rules that apply to the dispute, including mandatory consumer protections. No binding-arbitration obligation or class-action waiver is imposed by this version of the terms.
Any future governing-law, binding-arbitration or class-action provision must be separately finalized and disclosed, and will require acceptance to the extent required by law; it will not be treated as agreed merely because it was proposed. Existing rights are not retroactively waived.
We may update these terms and will post the revised date and provide notice of material changes where required. Changes apply prospectively subject to applicable law and any required consent. If any provision is unenforceable, the remaining provisions continue to apply to the extent lawful. Feature-specific disclosures supplement these terms but cannot override non-waivable legal rights.
AmpliHit Finished Product Promotion Agreement
Agreement version: 2026-10-12-v1
Scope. This agreement covers finished products I produce using AmpliHit and release, publish, share, export, or download from the app, including finished music or audio, videos, cover artwork, graphics, promo cards, press kits, and promotional copy. It does not authorize use of private drafts, unfinished projects, unreleased source files, account information, or unrelated content merely uploaded to the app. It applies to existing finished products I have already released from AmpliHit and future finished products I release after accepting.
Permission. I grant AmpliHit a non-exclusive, worldwide, royalty-free license to reproduce, display, perform, distribute, and share those finished products solely to promote AmpliHit, publicize its services, showcase what users create with the app, and advance awareness of the app. This includes its website and app, social media and YouTube, advertising, emails, demonstrations, press coverage, and promotional partnerships. AmpliHit may provide the products to platforms and service providers only as needed for these promotional uses. AmpliHit does not need separate approval for each such use.
Ownership and limits. I keep ownership of my products and may use or license them elsewhere. This agreement does not transfer ownership, authorize sale or licensing of my products as standalone merchandise, or authorize creative edits, excerpts, remixes, or adaptations. Technical formatting and file conversion that preserve the finished product are permitted. The artist name, product title, and credits already accompanying a product may be displayed with it; private personal information and unrelated likenesses are not included in this permission. No promotional payment or royalty is promised, and promotional use is not guaranteed.
Rights and restrictions. I confirm that I own or control the necessary rights or permissions for the finished products, including any incorporated recordings, compositions, artwork, voices, and likenesses. This agreement does not grant rights I do not have or override third-party licenses, music-service rules, copyright restrictions, or any separate consent required by law. It does not authorize rebroadcasting audio from streaming services without the necessary rights. I will not release products that I lack permission to authorize for these promotional uses.
Ending permission. I may request that AmpliHit stop future promotional use of a product through the app’s Contact page, or remove that product from the app. AmpliHit will stop new promotional use of that product after receiving the request or removal. Materials already published, shared, or distributed may remain available, including third-party copies and archival records. Ending permission does not transfer ownership or undo uses authorized before the request.
Electronic acceptance. By checking the acceptance box and selecting “Accept and continue,” I confirm that I have read this disclosure and agree to this license. My checkbox is my electronic acceptance. AmpliHit records my account identity, the agreement version and exact wording, and the acceptance date and time. Acceptance is required to continue using the signed-in app; if I do not agree, I may sign out without granting this permission.
